KAYAMO REFERRAL PROGRAM TERMS AND CONDITIONS


Kayamo Atlas Lending Corp. ("Kayamo") offers brand supporters (“Referrer” or “You”) the opportunity to participate in its referral program (the “Program”). The duration of the Program is from 4 December 2023 to 4 December 2024 per DTI Fair Trade Permit No. FTEB-181503 Series of 2023.

Referrers are bound by these Terms and Conditions by participating in the Program. By participating in the Program, Referrers agree to use the Program in the manner specified in these Terms and Conditions, and as promoted in Facebook and Instagram. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as a Referrer or to participate in the Program in any other manner. Referrers may not participate in the Program where doing so would be prohibited by any applicable law or regulations.

Kayamo reserves the right to disqualify any Referrers from participation in the Program at any time if he/she does not comply with any of these Terms and Conditions or otherwise fails to comply with any applicable laws, rules, regulations and procedures. No part of the program is directed to persons under the age of 18. IF YOU ARE UNDER 18 YEARS OF AGE, YOU MAY NOT USE, ACCESS OR PARTICIPATE IN THE PROGRAM AT ANY TIME OR IN ANY MANNER.

I. How the Program Works

A. Program Participation, Generally.

1. To participate in the Program, Referrers should visit https://kayamo.com.ph/referral and follow the on-screen instructions to register themselves to the Program.
2. Individuals who receive a referral via a Referrer are "Friends" (or, singly, a “Friend”). An "Eligible" Referrer who is fully compliant with these Terms and Conditions may receive "Reward(s)" for every "Qualified Referral” (all terms in quotes to be understood as defined below).

B. Eligible Referrer

1. To be "Eligible," a Referrer must:
  a. Be at least 18 years old;
  b. Register his/her e-mail address; and
  c. Register his/her mobile number.

C. Making a Referral

1. A Referrer must register at https://kayamo.com.ph/referral to make a referral. Once the registration is complete, he/she will be provided with a referral link through a confirmation email.
2. The referral link can be forwarded to Friends that intends to apply for a loan.

D. Qualified Referrals

A “Qualified Referral” means that all the following conditions are met:
1. The Friend completes the registration process in Kayamo’s website https://kayamo.com.ph.
2. The Friend completes the application process following the procedures in Kayamo’s website.
3. The Friend submits the required documents/ information relative to his/her application.
4. The Friend’ loan application is approved and granted by Kayamo.

E. Earning Rewards

1. Once the referred loan application is approved by Kayamo, Referrer shall receive 1% of the approved loan amount (“Reward”) through the Referrer’s nominated bank or electronic wallet.

F. Validated Qualified Referrals

1. Rewards are subject to validation. Kayamo may refuse to process any transaction it deems to be fraudulent, suspicious, in violation of these Terms and Conditions, or believes will impose potential liability on the company, its subsidiaries, affiliates or any of their respective officers, directors, employees, representatives and agents.
2. Rewards earned by Referrers are non-transferrable and non-assignable to third (3rd) persons.


II. Privacy.

Referrers may participate in the Program made available by Kayamo in order to refer their Friends to as potential clients. To do this, Referrers must necessarily submit personal information about themselves, such as their names, e-mail addresses and mobile numbers as contact information. Kayamo shall use and process personal information in accordance with Republic Act (“RA”) No. 10173, otherwise known as the “Data Privacy Law,” and relevant rules and regulations.

III. Content Ownership and Use.

A. Kayamo’s online platform and the Program contain content that includes: designs, text, graphics, images, video, information, logos, button icons, software, audio files, computer code, and other content (collectively, "Content"). As between Referrer and Kayamo, all Content is the property of Kayamo. The compilation (meaning the collection, arrangement, and assembly) of all Content on Kayamo’s online platform or the Program is the exclusive property of YSI and is protected by copyright, trademark, and other laws.

B. License to You. Kayamo authorizes you, subject to these terms, to access and use Kayamo’s online platform, the Program, and the Content solely for your personal, noncommercial use. Unauthorized use of the Content may violate intellectual property rules and regulations, and is strictly prohibited.

IV. Liability.

A. By participating in the Program, Referrers agree to:

1. Be bound by these Terms and Conditions; and
2. Defend, indemnify, release and hold harmless Kayamo, its related companies, together with their respective employees, directors, officers, from any and all claims, actions, demands, damages, losses, liabilities, costs or expenses caused by, arising out of, in connection with, or related to Referrers’ participation in the Program.


V. Disputes. Any dispute arising from the Program shall be resolved through:

1. Mediation, and
2. Court litigation. Disputes shall be resolved in the courts of Metro Manila, Philippines.

  • If either Party brings legal action to enforce its rights under this Agreement, the prevailing party will be entitled to recover from the other Party its expenses (including reasonable attorneys’ fees and costs) incurred in connection with the action and any appeal.     
  • The provisions of this agreement shall be governed, interpreted and construed in accordance with the laws of the Philippines and in the event of litigation, the venue shall exclusively be the relevant courts of law of the City of Makati, Philippines.
  • Any provision of the agreement that is prohibited or becomes unenforceable under the laws of the Philippines and which affects the performance or enforceability of this agreement shall, be deemed ineffective to the extent of the prohibition or unenforceable provision but without invalidating the remaining provisions of the agreement.
  • Nothing contained in this agreement shall be construed as creating any agency, partnership, joint venture, or employment between Kayamo and the Borrower. Neither party will have authority to contract for or bind the other party in any manner related whatsoever.  


VI. General Terms.

A. These terms constitute the entire agreement between Referrers and Kayamo concerning Referrers' use of the Program. The failure of Kayamo to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision. A person who is not a party to these terms shall have no right to enforce or receive the benefit of any of these terms.
